The three main categories of FSSAI licenses in India are Basic Registration, State License, and Central License. The category a food business operator (FBO) falls under depends on their turnover and production capacity. 

Here's a breakdown:

  • Basic Registration:

    This is for small FBOs with an annual turnover of less than ₹12 lakh, such as small cafes, restaurants, food hawkers, and food stalls. 

  • State License:

    FBOs with an annual turnover between ₹12 lakh and ₹20 crores can apply for this license. 

  • Central License:

    This is required for larger food entities with an annual turnover exceeding ₹20 crores. It's also mandatory for businesses operating in multiple states, importers, exporters, and those dealing with proprietary foods

Kind of Business Required Food Licecnce :

Petty Food Business Operators Manufactures or sells any kind of food by himself/herself, Petty retailer, hawker, itinerant vendor, temporary stall, Thela, Sweets Shop, Juice Stall etc. e.g Gol gappa stall, fruits/vegetables vendors, snacks stall, Tea Stall, Samosa, Bread pakoda, retail shops, Temporary Food Stalls like Chinese food stall, South Indian Food etc. Temporary or fixed stall or food premise involved in preparation, storage, distribution and sale of food products that can be served as a snacks/ tea/coffee and similar variants. Hawker - Selling packaged or freshly prepared food by travelling (usually on foot or movable carts) from one location to other

All Food Manufacturing/ Processing units (other than Dairy Units, Vegetable Oil, Meat Processing and Slaughtering Houses Manufacturing/Processing Unit) means a person/entity which owns or operates an establishment that manufactures or processes a food product.

This term includes, but is not limited to contract manufacturers, contract packers and other entities that manufactures or processes a food product. Manufacturing or processing means each step in conversion of raw material derived from livestock and agricultural produce into products for intermediate or final consumption.

The process includes procurement, receipt, preparation, Manufacturing/processing, packaging, storage, distribution & transportation of food products. Repacking means packing of food product into different sizes with labelling after doing minimal processing as required like sorting, grading, sieving etc. from wholesale packages. The food product is not manipulated & the composition or formulation is not affected or changed.


Dairy Units including Milk Chilling Units Dairy processing means handling, processing, manufacturing, packing, storing, distribution & transportation of milk and milk products. Note: Registration for Petty Milkman, Milk Vendors, License for rest according to Eligibility criteria


Vegetable Oil Processing Units Vegetable oil processing means processing of vegetables to produce vegetable oils by the process of solvent extraction/expeller and refining including oil expeller units

GET Slaughtering House Slaughtering means a process of transporting, stunning, butchering, dressing, processing, storing & distribution of live animal/poultry birds


Meat Processing Meat processing means further processing of slaughtered animals/poultry birds into meat & meat products, packaging, storing & transportation of meat & meat products. Fish processing means handling, processing of fish, manufacturing of fish products, packing, storing, distribution & transportation of fish and fish products.


Food or Health Supplements and Nutraceuticals etc. As per Food Safety and Standards (Food or Health Supplements, Nutraceuticals, Foods for Special Dietary Uses, Foods for Special Medical Purpose, Functional Foods, and Novel Food) Regulations, 2016]


Non-specified food “Non-specified food” means any food other than proprietary food or food ingredients, including additives, processing aids and enzymes for which standards have not been specified in any regulation made under the Act

E-Commerce

E-commerce also known as electronic commerce or internet commerce, refers to the buying and selling of goods or services using the internet, and the transfer of money and data to execute these transactions. Ecommerce is often used to refer to the sale of physical products online, but it can also describe any kind of commercial transaction that is facilitated through the internet


Transporter (having a number of specialised vehicles like insulated refrigerated van/wagon, milk tankers etc.) Transportation is an activity of transporting food products (both packed and bulk) from one location to another in vehicles/containers including specialized vehicles like insulated refrigerated van/ wagon, oil/milk tankers etc. Food Trucks are also covered in this category

Wholesaler Wholesale is an activity in the distribution channel where food product is procured in bulk and then sold to resellers/retailers rather than to consumers


Distributor Distribution is an activity in the distribution channel where food product is distributed from the original place of manufacture to the person who makes the final delivery or sale of the food product to the ultimate consumer.


Retailer Retail is an activity where food products is procured from a manufacturer, distributor or wholesaler and sold to the ultimate end user. E.g. Retail Shop/ Fish/ Meat/Poultry shop/ seller/Sweet Shop/Snacks/Confectionery or Bakery Shop


Hotel Hotel is a commercial establishment providing lodging, meals, and other guest services. In general, to be called a hotel, an establishment must have a minimum of six letting bedrooms, at least three of which must have attached (ensuite) private bathroom facilities


Restaurants Restaurant is a type of food service operation which prepares, serves food and drinks to customers in exchange for money. Meals are generally served and eaten on the premises, but many restaurants also offer take-out and food delivery services, and some offer only take-out and delivery.



Club/Canteen Canteen or Cafeteria is a dining area in an institution/ establishment serving food (being prepared in the premises or procured from other location or source) to individuals associated with or visiting the institution


Caterer Food Service Establishment involved in preparation, storage, serving and /or transport of food for consumption of a group at a venue of ceremony/celebration /ritual/institution

Dhaba Food service establishment generally located near roadside/highway involved in processing, storing, packaging and selling of food to customers for consumption


Boarding houses serving food

A building providing food and lodging for paying guest. Banquet halls with food catering arrangements A specified area such as hall which is used for the purpose of hosting parties/ ceremonies involved in preparation and serving of food to customers for consumption.

Home Based Canteens/ Dabba Wallas

An individual or establishment involved in distribution of packed meals (usually packed lunch) from food service establishments such as home based caterer or restaurants to customers.


Permanent/ Temporary stall Holder

A stand/booth/compartment/small covered area being used for preparation and /or sale of freshly prepared or packaged food for consumption. This structure maybe temporary or permanent (fixed).

How many stages are there in a food license process?The Food Safety and Standards Authority of India (FSSAI) issues food licenses in three stages: Basic Registration, State License, and Central License. FAQ :

Q1. What is the qualification criteria for the in-charge of operations for the re-labeller KoB? 


Ans: As per the FSSAI order 1(5)/Enf-1/FSSAI/2012 dated 25.04.2013, the Relabeller shall nominate one officer responsible for compliance with licensing conditions across all relabeling units. Further, as Relabeller does not require a person in-charge of operations [who does not own any manufacturing unit of its own], he may nominate the person responsible for complying with the conditions of the license as the person in-charge of operations also, for the purpose of filing application for license [Form B] without any compulsion for specific qualification.


Q2. Is it mandatory to mention FSSAI license/registration number on receipts/invoices/cash memo/bills etc. by food businesses on sale of food products?


Ans: Yes, it is mandatory to declare 14-digit FSSAI License or Registration number on cash receipts/ purchase invoices/cash memo /bills, etc. by all food businesses. When any operator issues 2 transaction documents such as in the case of transporters issuing transport challan/ Bill etc. and an invoice, then FSSAI number needs to be mentioned on both documents. The only exemption will be the GST e-way bill and such other govt. documents that are system generated. Please also refer FSSAI order vide 15(31)2020/FoSCoS/RCD/FSSAI dated 8th June 2021.


Q3. What is the appropriate category, if I am getting my food products manufactured through third-party manufacturers?


Ans: A food business operator getting his products manufactured/packed from third-party manufacturers/processors is a ‘Relabeller’ and shall apply for license under Relabeller Category [under Manufacturer Group in FoSCoS]. Also refer FSSAI order 1(5)/Enf-1/FSSAI/2012 dated 01.04.2013. User Manual for applying Relabeller license. 


Q4. If an e-Commerce/Retail/Wholesale FBO is also involved in operation of warehouse/storage/wholesale store/retail store activities, then who shall obtain FSSAI License / Registration for the warehouse / storage/ wholesale store/retail store premises?


Ans: E-commerce/Retail/Wholesale FBOs who are involved in the operations of warehouse/storage/wholesale store/retail store activities are required to obtain an FSSAI license/registration. It may also be noted that individual sellers are not required to obtain a separate FSSAI license/registration for the same warehouse/storage/wholesale store/retail store facility which is already licensed / registered and provided by a partner Wholesale /Retail /e-commerce FBO platform.


Q5. What is the appropriate category, if I am involved in supplying of the food items?


Ans: FBO engaged in the supply of food items may apply under either distributor and/or wholesaler and/or transporter category.


Q6. I have FSSAI license/registration under ‘Supplier’ and/or ‘Marketer’ Kind of Business (KoB), but it is disabled now from the online system (FoSCoS). What action do I need to take?


Ans: ‘Supplier’ and/or ’Marketer’ category has been disabled w.e.f. 16th September 2021 due to the overlapping nature of the activity. Existing FSSAI licensee under ‘Supplier’ and/or KoB license may still renew their license under the same KoB, but are required to modify the license/registration & select appropriate KoB during the subsequent modification of the license/registration.



Q7. Who is an E-commerce entity / Food Business Operator?


Ans: “E-Commerce entity or Food Business Operator” means any person/Company who owns, operates, or manages a digital or electronic facility or platform for electronic commerce, but does not include a seller offering his goods or services for sale on a marketplace e-commerce entity, wherein goods or services are as defined under section 3(j) and 3(n) of the Food Safety and Standards Act, 2006 i.e. definition of "Food" and "Food business" respectively.


Q8. I am a Manufacturer having FSSAI Registration for my food business. Should I declare FSSAI Registration number [2xxxxxxxxxxxxx] on my product labels?


Ans: Yes, Petty FBOs are also required to declare the FSSAI Registration number [2xxxxxxxxxxxxx] on the product labels as per the specifications specified for mentioning the FSSAI License on Product Labels under clause 2.2.1.7 of the Food Safety and Standards (Packaging and Labelling) Regulation, 2011, subject to the condition that the term License would be replaced with the term Registration.


Q9. If I am eligible for FSSAI Registration or State License as per the current turnover/ capacity of my food business; can I apply for a higher category of license i.e. State License or Central License respectively?


Ans: It is suggested that FBOs should apply for the registration or license under their eligible category; however, if an FBO voluntarily wants to apply for a higher category of license than their eligibility, he may be allowed to do so subject to the fulfillment of all other requirements such as conditions and compliance associated with the category of License.


Q10. Is it mandatory to enclose NOC from manufacturers in case of applying for license for Repacker category?


Ans: In case, a Repacker wants to display the name of original manufacturer on the product label, he/she needs to obtain NOC from the manufacturer and enclose it as a mandatory document for license. Further, in case, a Repacker owns the compliance of the food product as per FSS Act, 2006, Rules and Regulations thereunder and does not want to mention the name of the manufacturer but wants to mention packed by him on the label, he shall give an undertaking on his letterhead while applying for license. On behalf of the undertaking submitted, he may be exempted from the requirement of NOC from the manufacturer.



Q11. What is the frequency at which potable water is to be tested if being used as an ingredient in food?


Ans:

Food businesses using water as an ingredient in food, shall get the water tested for BIS IS 10500[except radioactive parameters] at least once in every financial year with at least six months gap between the two testing of water samples.

(i) Further, this requirement is not mandatory in the case of Food Business Operators using potable water supplied by Municipal Corporation [Government Body] subject to maintaining of water bill records.

(ii) Food Businesses using Potable water supplied by Mall/Commercial Hub/Market or any private authorities shall obtain the water testing report from these authorities as per the mentioned frequency.

This water testing report is required while applying for license (as a mandatory document) and to be produced to the Food Safety Officer or Third Party Audit Agency/Auditor authorized by FSSAI at the time

of inspection/audit.


Q12. Is FSSAI License under Importer KoB sufficient to carry out further food Business activities of Imported Food Products?


Ans: No, FSSAI License under Importer KoB is only for importing food Items into the Country. For carrying out further food business activities of that imported food products, as defined under clause 3(n) of the Food Safety and Standards Act, 2006, FBOs need to endorse all such relevant Kind of Business categories in the issued license, by applying modification of license.


Q13. How can Food Businesses and consumers know about FSSAI updates/Orders/Advisories etc.? 


Ans: Food Business Operators (FBOs)and Consumers can visit https://fssai.gov.in/advisories.php or download

FoodSafetyConnectApp(https://play.google.com/store/apps/details?id=safety.connect.food) on their mobiles to check recent updates/Orders/Advisories etc. issued by the FSSAI.


Q14. I want to shift my food business unit to another location. Can I retain the existing license number for the new location?


Ans:

Yes, Food Businesses can retain their existing License/Registration number upon change of their

premise address by applying for Modification application on the FoSCoS Portal with the applicable

modification fee. Kindly refer to FSSAI order no. RCD-01001/4/2021-Regulatory-FSSAI dated 30th

September 2021 issued in this regard, for more details.


Q15. What is the official URL of FoSCoS?


Ans:

The official URL of FoSCoS is https://foscos.fssai.gov.in. The FBOs are advised not to submit details

or pay any money on any other website. Further, FSSAI shall not entertain any

request/complaint/grievance pertaining to websites other than the Official FoSCoS website.


Q16. If an FBO is using potable water supplied by Municipal Corporation [Government Body] as an ingredient in food, then do they need to enclose a water test report while applying for a license as a mandatory document?


Ans: No. The Food Business Operators using Potable water that is being supplied by Municipal Corporation [Government Body] can enclose water supply bills for commercial use in place of the Water Test Report as a mandatory document for applying for a license.


Q17. If the FBOs are using the water supplied by Mall/Commercial Hub/Market or any private authorities etc. as an ingredient in food, then is it mandatory to enclose a water test report while applying for a license?


Ans: Yes. However, Food Business Operators using Potable Supply water supplied by Mall/Commercial Hub/Market or any private authorities can enclose a water testing report [as prescribed under KOB wise Mandatory Documents for License] obtained from Mall/Commercial Hub/Market or any private authorities, as a mandatory document for applying for a license. The water testing report obtained from Mall/Commercial Hub/Market or any private authorities shall not be older than one year.


Q18. When will I get License / Registration in case I do not receive any response from the Licensing/Registering Authority within the stipulated time?


Ans: In case no response is received from the concerned Registering/ Licensing Authorities within the stipulated time, as specified in the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulation, 2011, Registration Certificates and Licenses are auto-generated, as per the provisions of FSSAI order No.15(31)2020/FoSCoS/RCD/FSSAI dated 24th May 2021 issued in this regard.


Q19. Which category of FSSAI License is required for the Manufacturing of Nutraceuticals and related food products?


Ans: Food Businesses, manufacturing food products covered under Health Supplements, Nutraceuticals, Food for Special Dietary Use, Food for Special Medical Purpose, Functional Food, and Novel Food are covered under the purview of Central License category as per FSSAI order No.15(31)2020/FoSCoS/RCD/FSSAI dated 16th September 2021 issued in this regard.


Q20. . I have applied for a Manufacturing type of License for multiple products. However, I am not able to provide a satisfactory reply to the queries raised by the Licensing Authority against some of the products. What should I do to get my license quicker?


Ans: : Manufacturers who have applied for licenses for multiple products and are facing queries in some of the products, may delete those products from application for faster processing of their applications. Deleted Products, if required, can be added later through modification of the issued license with a modification fee of Rs. 1000 only. Kindly refer to FSSAI Advisory no. RCD-01002/1/2021-RegulatoryFSSAI dated 16th December 2021 issued in this regard, for more details


Q21. How can I login to FoSCoS portal in absence of my FoSCoS User-ID?


Ans: FBOs can use their License/Registration Number or Application Reference Number and their existing password to login into the FoSCoS portal. Kindly refer to FSSAI order no.15(31)2020/FoSCoS/RCD/FSSAI dated 25th November 2021 issued in this regard, for more details.



Q22. Is it required to submit Annual return [and penalty due to delay in submission, if any] while applying of renewal of license?


Ans: FBOs are required to pay the penalty levied due to delay in submission of Annual Returns [subject to maximum penalty levied shall not exceed 5 times of the annual license fee] before applying for the renewal of their licenses. This has come into the effect from FY 2021-22 onwards. Refer FSSAI Order number 15(31)2020/FoSCoS/RCD/FSSAIpt1 dated 10th November 2022.


Q23. Is it mandatory to submit Import Export Code (IEC) document by manufacturers who are not exporters themselves but manufacturing products meant for export [which are not meeting standards as per Regulations made under Food Safety and Standards Act, 2006] while applying for license?


Ans: As per FSSAI Order number 15(31)2020/RCD/FoSCoS/RCD dated 19.03.2021 regarding KOB-wise list of documents required for license, Manufacturer-Exporter are required to submit additional document as `IEC document` issued by DGFT. However, the manufacturers [of Products meant for export purpose - not meeting the standards made under FSS Act, 2006] and who are not the exporters themselves [and do not possess the IEC document] but exporting through Merchant-Exporter may upload an agreement with Exporter [Trader] indicating such products in place of mandatory requirement of IEC document for the purpose of making license application through FoSCoS. Such Manufacturer shall update the information through filing application for Non-Form C modification [without fee] as and when he adds/modify the agreement with Exporters [Trader].



Q24. What is the appropriate Kind of Business for Direct Sellers (engaged in selling food items) for obtaining FSSAI License/registration?


Ans:

A New Kind of Business (KoB) has been created for ‘Direct Sellers’ in FoSCoS under Trade/Retail category for licensing/registration purpose wef 10th July, 2024. Kindly refer to FSSAI order No. RCD-15001/6/2021-Regulatory-FSSAI-Part(1) dated 16th July, 2024 for more details.

Q25. Are different Licenses required to conduct a different kinds of food business activities at the same premise?


Ans: FSSAI license is based on the premise. All kinds of food business activities that are being conducted at the same premise can be applied for in a single FSSAI license.


Q26. How to convert manually issued licenses/ registration to online during the renewal of license?


Ans: FBO can approach the Designated Officer [Licensing Authority] or Registering Authority of that area. Designated Officer/ Registering Authority will enter the details of the offline issued license/registration in the FoSCoS portal. Thereafter, the license/registration can be renewed through online process, whenever required.


Q27. What are the advantages of converting your manually issued license to the online licensing and registration system [FoSCoS]?


Ans: FoSCoS portal sends regular alerts to FBOs regarding various compliances through email and SMS. FBOs will be able to track the compliances attached with their licenses/registration from time to time and can avoid penalties if any.


Q28. Who are petty food business operators? What is the eligibility for FSSAI registration certificate?


Ans: : Petty Food Business Operators (FBO) are those who manufacture or sell any article of food or a petty retailer, hawker, itinerant vendor or a temporary stall holder or small scale or cottage or such other industries relating to food business or tiny food business operator having annual turnover up to Rs. 12 Lacs and/or whose i.production capacity of food products does not exceed 100 kg or litres per day, or ii. procurement or handling and collection of milk is up to 500 litres of milk per day, or iii. slaughtering capacity is 2 large animals or 10 small animals or 50 poultry birds per day or less These FBOs are required to obtain FSSAI Registration Certificate by applying on Food Safety Compliance System or Food Safety Connect app. This Registration Certificate is embedded with a QR code and has the image of FBO with a 14-digit Registration number starting with 2 (2xxxxxxxxxxxxx).


Q29. My License/Registration is suspended or cancelled. Do I need to stop food business activities?


Ans: : On the suspension or cancellation of his/her license or registration, a food business operator needs to stop food business activities immediately. Carrying out any food business activity on suspended or cancelled License/Registration is an unlawful activity and shall attract penal actions under FSS Act, 2006.


Q30. Do I need to obtain FSSAI License for utensils/packaging material meant for serving or packaging food?

Q31. My License was cancelled. Can I apply for a fresh License?


Ans: : After 3 months from the date of cancellation under Regulation 2.1.8 (3), the Food Business Operator may make a fresh application for Registration or license to the concerned authority if all observations made in the improvement notice have been complied with.


Q32. My application has been reverted with some queries on it. What to do? Or the Status of my application is "Application has been sent back for modification/editing", how to proceed now?


Ans: : Respond to the queries raised by Licensing or Registering Authority within 30 days. The application for the editing/modification shall be available on the dashboard of the applicant. If an applicant does not respond to the queries of Licensing or Registering Authorities within the stipulated time, the application will be auto rejected.


Q33. Who will issue licenses to food business operators under railway premises?


Ans: FSSAI license/Registration for food premises under Railways are issued by the Indian Railways Designated Officers/Registering Authorities as notified by Food Authority from time to time.


Q34. Who will issue the FSSAI license to food business operators under Airport/Seaport premises?


Ans: : FSSAI licenses for food premises at Airport/Seaport are issued by Airport Health Officers (APHOs) or Port Health Officers (PHOs) who are notified as Designated Officers (DOs) by Food Authority. Airports/Seaports where APHOs/PHOs are not notified as DOs, the Central Licensing Authority (CLA) of the respective area would issue the license.


Q35. What are the different categories of licenses?


Ans: As per "FSS (Licensing & Registration) Regulations, 2011, Licenses and Registrations are granted to FBOs in a 3 tier system i.e. Registration, State license, and Central License. Eligibility Criteria is available on the homepage of the Food Safety Compliance System (https://fssai.gov.in )


Q36. I am working/manufacturing or conducting food business activities from my home for a registered Cooperative Society/Gruh Udyog/Mahila Udyog/ Self Help Group or any similar government-registered society. Do I need to obtain separate FSSAI registration for myself?


Ans: FSSAI vide order number 03-01/2012/Enf-I/FSSAI dated 21st Jan 2015 exempted individual members to obtain FSSAI registration certificate. He/she must be a registered member of the society which is licensed/registered with FSSAI and subject to all such conditions as laid down in the order.


Q37. I have a pulses/grains milling unit. What kind of license do I need to obtain?


Ans: Pulses/Grains etc. milling unit comes under Manufacturing Kind of Business. These milling units are exclusively covered under the State License irrespective of their production capacity.


Q38. If I have more than 10 food vending machines, being operated by third parties with an annual turnover of more than 12 lakhs, who should get registration?


Ans: In the case where a food vending machine has an annual turnover of more than Rs.12 Lacs, it shall be licensed with FSSAI. For the vending machines having an annual turnover of up to Rs.12 Lacs, the parent entity shall obtain FSSAI license in reference to FSSAI orders numbered 15(6)2018/FLRS/RCD/FSSAI dated 08th July 2019 and 19th Sep 2019 issued in this regard.


Q39. Are physical documents required to be submitted at Regional/State Offices for License after submitting online application?


Ans: No, there is no need to submit physical documents at Regional/ State offices for Central/ State license


Q40. What is the fee for modification of license?


Ans: : If there is any change that alters the information contained in the license certificate (Form C), Food Business Operator shall apply for modification of license with a fee of Rs. 1000 plus the differential fee, equal to the difference in annual license fee, in case of upgradation. No fee is required for modification of non-form C details such as Change in Form IX Nominee (person responsible for complying conditions of license) or any supporting documents.


Q41. Repetition of IEC Code of Importer allowed?


Ans: : An importer cannot submit another application with the same IEC unless he deletes the application (complete or incomplete) or surrenders the license where this particular IEC has been used.


Q42. I have closed down my food business. How to surrender the FSSAI License/Registration?


Ans: You need to apply online for surrendering the License or Registration by login into the Food Safety Compliance System (FoSCoS) account from which the license/registration application was filed. After approval of the concerned authority, it will be considered surrendered.


Q43. How to transfer the License from one owner to another in case of the death of the owner?


Ans: : License can be transferred in case of the death of the owner. Transfer applications can be made online. For transfer of License, Death Certificate and Proof of Legal Heir is required.


Q44. How and where to appeal against the order of Licensing/Registering Authority?


Ans: : Under Section 32 (4) and 32(5) of FSS Act, 2006, any person who is aggrieved by the decision of Licensing/Registering Authority, may appeal to the Commissioner of Food Safety whose decision thereon shall be final. The period within which such an appeal may be brought shall be fifteen days from the date on which notice of the decision was served through any of the available modes. In case of an appeal against an improvement notice, the period shall be 15 days or the period specified in the improvement notice, whichever expires earlier.


Q45. At which points, an inspection of my food business will be conducted?

Ans: : On receipt of an improvement notice, you need to act upon the suggestions given for improvement by the concerned authority. A minimum of 14 days shall be granted by the concerned authority for submission of the compliance report.If you are aggrieved by the improvement notice or any decision of the concerned authority, you may appeal under Section 32 of the Food Safety and Standards Act, 2006 to the Commissioner of Food Safety whose decision thereon, shall be final.


Q47. My License/Registration has been suspended. How suspension can be revoked?


Ans: In the improvement notice issued to the food business operator (FBO) for suspension, the ground for suspension is given. FBO is required to take remedial action as directed in the improvement notice and inform Licensing Authority. If satisfied with the steps taken by the FBO, Licensing Authority may revoke suspension with or without conducting the inspection. The FBO may also appeal against the Improvement Notice vide Section 32(4) of FSS Act, 2006.

Ans: If a Food Business Operator (FBO) has his food business premises located in two or more States, he is required to obtain a Central License for his Registered Office or Head Office in addition to the license/registration for each unit/premise. A separate license or registration has to be obtained for each unit/premise depending upon that unit’s capacity or turnover, from the concerned Central or State licensing authorities. Further, if there is any food business activity conducted on Registered Office/Head Office premise, the same shall also be incorporated in Head Office License.


Q55. Under which circumstances can the Designated Officer (DO) suspend or cancel the FSSAI license or Registration?


Ans: : The DO may suspend the license of a Food Business Operator (FBO) if they are not complying with the improvement notice. The DO may further cancel the suspended license after giving the FBO an opportunity by issuing a show cause notice.


Q56. Will a license be required for a catering establishment that comes under the Central Government?


Ans: Yes, all catering establishments, even those under central Government such as Railways, Airport, Seaport, Defense etc. will have to get a license from FSSAI.

Q63. Do I need to register/mention all food products in FSSAI License which I manufacture or process in my food premise?


Ans: : Food Business Operators (FBOs) shall only manufacture/process food products after getting them endorsed on FSSAI License. Ans: : FSSAI License number is of 14 digits and starts with "1" while FSSAI Registration number is also of 14 digits and starts with "2".


Q67. I have manufacturing units in multiple states. Will I be required to get a common license for the company or an individual license for each unit?


Ans: You will be required to obtain a Central License for the Head Office/Registered office of your company and an individual Central or State license or Registration Certificate (as per the eligibility criteria of respective units) for each manufacturing unit, in particular, State/UT.


Q68. Are there any authorized facilitators/consultants of FSSAI for filing applications of FSSAI License/Registration?


Ans: : FSSAI has created an ecosystem of Food Safety Mitras (FSM) for assisting food businesses in licensing and registration related matters. Under FSSAI"s Food Safety Mitra Scheme, Digital Mitras are being recognized and trained by FSSAI who provide help to Food Business Operators in filing applications for licenses and registrations. The Service charges of FSM fixed by FSSAI are as follows: a) Rs.100/- for filing of registration application/modification of Registration certificate/annual declaration for registration b) Rs.500/- for filing of license application/modification of License/annual returns for license.


Q69. What is the significance of the Nomination of the person in Form IX? Is it mandatory to nominate a person for a food business?


Ans: : Every Licensed FBO shall inform the Licensing Authority in Form IX, of the particulars relating to the concerned head or the person in charge of such establishment, branch, or unit, with due certification that the concerned person has been so nominated for compliance under FSS Act and Rules and Regulations made thereunder. Every FBO, other than the proprietor needs to nominate a person and convey it to Licensing Authorities in Form IX.


Q70. Do I need to file an annual return for my food business activities?


Ans: : FSSAI Licensed FBOs involved in Manufacturing (including repacking and relabellers i.e. FBOs getting their food products manufactured by third-party manufacturers) and importing of food products need to submit Annual Returns in Form D1 by 31st May of every preceding financial year, only through FoSCoS Portal.


Q71. What is the penalty for late or non-submission of Annual Returns?


Ans: : Non-submission of annual return beyond 31st May of every year will attract a late fee of Rs. 100 per day till the date of submission of annual return. Annual Returns penalty shall be submitted online by the FBOs on the FoSCoS portal w.e.f. FY 2020-2021.


Q72. Is there a mandatory requirement for all Manufacturers/Processors to compulsorily set up an in-house food testing laboratory?


Ans: : As per the condition of the License, FBOs involved in manufacturing/processing of Oils shall have an in-house laboratory facility for analytical testing of products. Further, FSSAI vide order number 15023/02/2017-QA (pt-2) dated 15th October 2019 has issued directions that all Dairy Processing units should follow a standardized Scheme of Sampling, Testing, and Inspection for monitoring of internal controls to ensure safe and good quality supply of milk and milk products to consumers. Detailed Scheme of Sampling, Testing, and Inspection is attached with the order (available at FSSAI’s website). The scheme came into force from 01st Jan 2020.


Q73. Do I need to give bill/cash memo to the purchaser?


Ans: : As per clause 2.1.14 of FSS (Licensing and Registration of Food Businesses) Regulations, 2011, every FBO involved in Business to Business trade shall give either separately or in the bill, cash memo, or label, a warranty in Form E to the purchaser.


Q74. What are the mandatory conditions of license pertaining to my food business?


Ans: There are certain Conditions of License as defined in Annexure 3 of Schedule 2 of Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011 which are to be complied with at all times by every FSSAI Licensed food business operator. Ans: Food business operators manufacturing fortified foods (Wheat, Rice, Milk, Oil, and Salt) are required to get these endorse on their FSSAI License by enclosing lab test reports of the products.


Q76. I have FSSAI License, can I use the +F logo on fortified food product labels?


Ans: Even, if an FBO has a valid FSSAI License, he needs to endorse fortified food in his/her FSSAI License. Only after approval of endorsement of fortified foods in FSSAI License, the FBO can use +F logo on endorsed products.


Q77. I have FSSAI License, can I use the Jaivik Bharat (Organic India) logo on food product labels?


Ans: Even, if an FBO has a valid FSSAI License, he needs to endorse organic food in his/her FSSAI License by enclosing the certification of the products obtained from NPOP/PGS-India. Only after approval of endorsement of organic foods in FSSAI License, the FBO can use Jaivik Bharat (Organic India) logo on endorsed product labels.

Q80. What is the maximum time for a grant of Registration Certificate after applying?


Ans: : A license has to be issued by the Licensing Authority within 60 days of making a complete application by an applicant.


Q81. Where to approach if the license is not issued within the prescribed timeline or unsatisfied with the decision of Licensing authority or application is rejected or license is suspended/ cancelled by the concerned authority?


Ans: : If you are aggrieved by the decision of the concerned licensing or registering authority, you may appeal to the Commissioner of Food Safety of your State under Section 32 of Food Safety and Standards Act, 2006. Q82. How many days in advance can the renewal of license or registration be filed?


Ans: A License or registration renewal application can be made as early as 180 days in advance. Further, Food Business Operator can now renew the FSSAI License/Registration even after the expiry date upto 180 days after expiry. Kindly refer to Q. 27 for more details.


Q83. I have still some days of validity left of my FSSAI License, still, the system is asking for the late fee, why and how the late fee is attached to the renewal application?


Ans: As per regulations, a renewal has to be filed not later than 30 days prior to the expiry of License to avoid the late fee for renewal of the License. A late fee of Rs. 100 per day is calculated and added to the renewal fee of License. i.e. if you are applying for renewal on the last day of expiry, a late fee of Rs. 100 x 30 = Rs. 3000 will be added to the renewal fee of the License.


Q84. I have submitted the payment/fee of License or registration through offline Treasury Challan. How do I submit the application?


Ans: In case license or registration fee is paid through offline treasury challan, the copy of treasury challan should be self-attested by the FBO and a 17-digit reference number shall be mentioned on the top of the treasury challan. The details of treasury challan, then, shall be filled and self-attested copy of it shall be uploaded in the application. The application then finally be submitted.There is no provision for offline payment in case of License application.


Q85. The status of my application shows that License or Registration is issued but I did not receive the license or registration yet. What is theissue?


Ans: FSSAI License or registration containing QR code is dispatched to email ids of FBOs after its issuance. FSSAI License is sent to email-id of the nominated person as declared. FSSAI Registration certificate is also sent to email-id as mentioned by the applicant. In case, you didn"t receive the mail of License or registration, please ensure the correctness of email-ids provided by you.FBOs also can download their issued License/Registration copies by login into their FoSCoS user accounts.


Q86. How can I check my FSSAI license renewal status?


Ans: Status of renewal of any License/Registration can be checked in yourFoSCoSaccount by login with user id and password. Another option is to track your application status atFoSCoS portal.


Q87. What are the other permissions required for obtaining FSSAI License?


Ans: The requirement of any other permission to conduct a food business in an area is determined by District/Local Administration. There is no prerequisite condition for obtaining permissions to apply for FSSAI License/Registration except mandatory BIS License/Receipt by Manufacturers of Packaged Drinking Water / Mineral Water [refer order No.13 (15)2017/PDW/Enf/FSSAI dated 26thMarch 2021] and CGWA NOC if extracting groundwater as per FSSAI order dated 2ndJanuary, 2018 and 21stJanuary, 2021. However, an FBO shall ensure that all the permissions have been taken asprescribed by District/Local Administration prior to commencing food business activities.


Q88. I have lost my FoSCoS user id/Password and also the registeredemail id and mobile number do not belong to meand therefore, I cannot use‘Forgot/Reset passwordutility’on FoSCoS. How to recover my FoSCoS user id credentials?


Ans: FSSAI vide Order number 15(31)2020/FoSCoS/RCD/FSSAI dated 25th November 2021introduced License / Registration number or application number based user ids to login in FoSCoS. Further, to update the credentials [email id and mobile number] attached to the license/registration or application, users can apply to their area officers as per SOP [Annexure-II] attached in the order. Q89. I initiated the renewal application before its expiry but got stuck at the payment page. Due to a technical error, I couldn"t complete my renewal application before the expiry of License or registration. How can I submit an incomplete application?


Ans: In case, a technical glitch has occurred while filing the renewal application, you need to provide proof (screenshots) of technical issue faced and lodge the same in the FBO Help section available under FoSCoS login. The issue will be accordingly examined by the concerned team at FSSAI Hq.


Q90. I am holding two FSSAI License, one State License and One Central for my food business unit. Is it correct to hold two licenses at a single premise?


Ans: FSSAI License is purely premised based. No FBO is allowed to possess more than one license for a single premise.Further, if the change in production capacity leads to change in criteria of License i.e. from State to Central, then FBO must apply for modification of existing State License to Central License category with modification fee [Rs. 1000/-] plus differential amount between State License fee and Central License fee. Also, refer FSSAI Order number 15(31)2020/FoSCoS/RCD/FSSAI dated 31stMay 2021.


Q91. I want to manufacture food products for importing countries. Food products differ from the standards as laid down under FSS (Food Products Standards and Additives) Regulations, 2011. Am I allowed to manufacture such products?


Ans: Manufacturers of food products meant for export are allowed to follow the standards of importingcountries.These FBOs need to declare to concerned Licensing Authorities that they shall not exhibit or expose such products in Indian market until or unless prior product approval is taken for such products from FSSAI HQ.


Q92. The production capacity of my manufacturing unit has increased and now, Iam falling under Central License. How can I update the productioncapacity?


Ans: As and when the production capacity of a manufacturing unit gets changed, it shall be communicated to concerned Licensing Authorities, through License modification application.Further, if the change in production capacity leads to change in criteria of License i.e. from State to Central, then FBO must apply for modification of existing State License to Central License category with modification fee [Rs. 1000/-] plus differential amount between State License fee and Central License fee. Also, refer FSSAI Order number 15(31)2020/FoSCoS/RCD/FSSAI dated 31stMay 2021.


Q93. I get my products manufactured through a third party manufacturer. Do I need FSSAI License? If yes, what is the Kind of Business for obtaining License for such business?


Ans: A food business operator getting his products manufactured/packed from third-party manufacturers/processors is a ‘Relabeller’ and shall apply for license under Relabeller Category [under Manufacturer Group in FoSCoS]. Also refer FSSAI order 1(5)/Enf-1/FSSAI/2012 dated 01.04.2013. User Manual for applying Relabeller license. 


Q94. Do Wine/Liquor retail shops require FSSAI License?


Ans: Alcohol is covered under the definition of food under section 3(n) of FSS Act, 2006. Q101. Online platforms providing only listing of FBOs require FSSAI License?


Ans: A platform that only lists FBOs but does not engage in any activity mentioned under Section 3(n) of FSS Act, 2006 is not required to obtainFSSAI license. However,they must list only those FBOs who possess valid FSSAI License or Registration.


Q102. FBO selling his/her products through his/her own e-Commerce/online platform require FSSAI License under e-Commerce?


Ans: Yes, FBOs selling their products through their own e-Commerce platform are required to obtain FSSAI License under e-Commerce category also.


Q103. Are Direct Sellers exempted from obtaining FSSAI License or Registration?


Ans: No, Direct Sellers are not exempted from obtaining FSSAI License or Registration. Only in the case, where Direct Selling entities are willing to take responsibility of their Direct Sellers and have given them in writing for owning such responsibilities, Direct Seller not required to obtain FSSAI registration certificates. Direct Sellers falling under the category of FSSAI License need to obtain a License under all circumstances. Refer FSSAI order number 15(6)2018/FLRS/RCD/FSSAI dated 08.07.2019 and 19.09.2019.


Q104. Can License for proprietary food be taken for Formulated Supplements for Children for the age group 24-36 months?


Ans: As per FSSAI order 15(15) 2018/CLAs/RCD/FSSAI dated 18th October 2019, License for proprietary food cannot be granted for Formulated Supplements for Children for age group 24-36 months under category 13.2 Complementary foods for infants and youngchildren.


Q105. Which Food Business Operators are classified as Repackers?


Ans:

Repacker” means a food business operator who repacks a food product into different sizes without changing or affecting the nature, composition or formulation of the food product. Repacker shall apply for license under Manufacturer Group in FoSCoS. Also refer FAQ on the requirement of NOC from Manufacturer for applying license under Repacker category.


Q106. Which Food Business Operators are classified as Relabellers?


Ans: A food business operator getting his products manufactured/packed from third-party manufacturers/processors is a ‘Relabeller’ and shall apply for license under Relabeller Category [under Manufacturer Group in FoSCoS]. Also refer FSSAI order 1(5)/Enf-1/FSSAI/2012 dated 01.04.2013. User Manual for applying Relabeller license. 


Q107. Is Star-rating certificate issued by the Ministry of Tourism required for obtaining FSSAI License?


Ans: FSSAI vide its order 12(1)2019/Hotel and Restaurant Association/RCD/FSSAI dated 7th Feb 2019 clarified that Star-rating certificate is not a prerequisite document for Hotels to obtain FSSAI License.In case, Hotel has obtained Star-rating certificate from the Ministry of Tourism (HRACC), the FBO needs to upload the same, otherwise, FBO needs to upload a self-declaration that he has not opted for star-rating from Ministry of Tourism (HRACC). Hotels without Ministry of Tourism’s Star rating are categorizedalong with one and two star Hotels for obtaining FSSAI License. Further, Hotels rated Five Star and above by Ministry of Tourism need to obtain Central License, and rest are needed to obtain State License/Registration.


Q108. Is there any requirement of NOC from Central Ground Water Authority for FSSAI License?


Ans: Yes. If an FBO is extracting groundwater(locatedin over-exploited areas)to conduct food business activities, he needs to obtain NOC from Central Ground Water Authority, prior to applying for FSSAI License. Refer Order no. 5(9)2017/CLA/DO Mumbai/RCD/FSSAI dated 02.01.2018.


Q109. Does a milk seller/ milkman require an FSSAI license/registration? Even if he is selling his milk to consumers directly.


Ans: Yes. All milk sellers/milkmen require FSSAI registration certificates if they are selling milk and milk products up to Rs. 12 Lacs per annum. If their sales cross Rs. 12 Lacs per annum,they need to obtain FSSAILicense.


Q110. Does a milk collection/chilling center require an FSSAI License/Registration?


Ans: Yes. A milk collection or chilling center requires an FSSAI License/Registration depending upon the volume of milk handled by the center.

In case, a centralized milk chilling/collection center is registered/licensed with FSSAI, then individual small chilling centers (set up at village level or so) need not to be individually registered with FSSAI. Their compliance of FSS Act and Rules and Regulations made therein shall be borne by Centralized milk chilling/collection center.


Q111. Does a milk seller/ milkman who supplies his whole production of milk to a Cooperative Society require an FSSAI license/registration?


Ans: If a milkman/ vendor is a registered vendor of Cooperative Society and selling his whole production of milk to that society, he is exempted from obtaining FSSAI Registration. In that case, Cooperative Society has to be licensed or registered with FSSAI.


Q112. If I am a canteen in a Central/State GovernmentOffice/Educational Institution/Bhawan/Hospital/Jail or similar establishment -what license should I get -state or central license?


Ans: If you are a food business operator(FBO) running canteen in a Central/State Government Organization, you are required to apply for Registration /State License/ Central License as per theeligibility criteria available on the homepage of Food Safety Compliance System. For License/Registration of Departmental Canteens/messes, etc. being run in the Central Government Premises, FSSAI vide order number 3(24)2018/Canteen/RCD/FSSAI/ dated 12thJuly, 2018 has rationalized. As per the said order, fee for canteens/messes being run in the Central Govt.Premises is given below: TypeEligibility CriteriaFeei. Q113. My FSSAI License number has changed. Can I use the pre-printed packaging material with older FSSAI License number?


Ans: In case of change of name, address or License number, you can apply for permission to use pre-printed packaging material. The request for permission shall be sent to FSSAI HQ with the prescribed fee. Refer FSSAI orders no. 12(2)2016/FBO Representation/Enf/FSSAI & 12(2)2017/FBO Representation/Enf/FSSAI dated 23/11/2016 & 14.11.2017 respectively, available at website (www.fssai.gov.in).


Q114. Where can I approach if Ihave a complaint against a Food Business Operator?


Ans: You can raise your food related grievance at FSSAI’s food safety connect portal (https://foscos.fssai.gov.in/consumergrievance/ ). You can also download the ‘Food Safety Connect’ app. Every lodged complaint is assigned a unique number through which a complainant can track the status of his/her complaint.


Q115. If I am an importer-do,I need a licence-which one?


Ans: Yes, all Importers need to obtain FSSAI Central License under Importer Category.


Q116. I already have an FSSAI"s State license. Can Iimportfood products on the same license?


Ans: Refer Q 93. FBOs need to obtain FSSAI"s Central License under Importer category for importing food products in India. If you already have an FSSAI"s State License, you are requiredtomodify your existing State License to Central License category for the addition of Importer Kind of Business with modification fee plus differential amount between State Licenseand Central License.Also, refer FSSAI Order number 15(31)2020/FoSCoS/RCD/FSSAI dated 31stMay 2021.


Q117. What does "food products handled" mean in the context of Annual Returns as specified under Clause 2.1.13 (1) of FSS (Licensing and Registration of Food Businesses) Regulations, 2011?


Ans: Here the word "food products handled" means-the food activity for which FSSAI license has been granted. If the Kind of Business (in FSSAI License) is Manufacturer/Repacker/Relabeller, then "food products handled" would mean ‘all food products endorsed in FSSAI License which were manufactured/processed including repacking and manufacturing by third party manufacturers during the previous Financial Year’.Similarly, if the Kind of Business (in License) is Importer, then "food products handled" would mean "food products importedduring the previous Financial Year" by the FBO.*Manufacturers-Exporters are also required to fileannual return wef FY 2021-22 onwards. [Refer FSSAI order number RCD-01001/4/2021/-Regulatory-FSSAI] For other Kind of Businesses (Such as Distributor, Wholesaler, Retailer, Storage, Transporter, and FoodServices, etc.) the provision of submission of annual return is not applicable, at present.


Q118. I want to start food/catering services through Food Truck. Which is the appropriate Kind of Business/Food Category for applying FSSAI License/Registration?


Ans: Food Trucks are covered under ‘Food Vending Establishment’ Kind of Business. You need to choose ‘Food Vending Establishment’ andthereafterappropriate Food Product Category fromavailable1 to 16. For example, FPC 16 is for Prepared Foods.


Q119. As per Clause 10.1.2 i.e. Health status under Schedule IV (Part II) of the Food Safety and Standards (Licensing and Registration of Food Businesses), Regulations 2011, arrangements shall be made to get the food handlers/employees of the establishment medically examined once in a year to ensure that they are free from any infectious, contagious and other communicable diseases. This one year is a financial year or a calendar year?


Ans: In the case of medical examination, the year referred to in Clause 10.1.2 shall be reckoned as a financial year. The FBO may in a given financial year get its employees/food handlers tested at any time. Further, in the case of a new food business, new recruits will have to undergo the medical examination before or at the time of joining.


Q120. As per point no.12 of Annexure 3 i.e. Conditions of License, testing of relevant chemical and/or microbiological contaminants in food products through own or NABL accredited/FSSAI notified labs is to be done at least once in six months. Kindly clarify these six months starts from which month of the year?


Ans: Testing of Food Products as per Condition of License number12 shall be carried out by manufacturers based on financial years i.e.first half year from April to September and second half year from October to March with at least three months’gap between two testing. Also, refer to FSSAI order vide number 15(31) 2020 / FoSCoS/RCD/ FSSAIdated 08th July 2021 issued in this regard.


Q121. Is it mandatory to submit BIS License or Application receipt while applying for FSSAI License for Packaged Drinking Water or Mineral Water?


Ans: Yes, FBO has to mandatorily upload a copy of BIS license or copy of the letter indicating recording of application for BIS license at the time of applying for new FSSAI license for Packaged Drinking Waterand Mineral Water on the online system of FoSCoS. Q122. Do FBO need to submit BIS license while applying of renewal of licensefor Packaged Drinking Water or Mineral Water?


Ans: Yes, BIS License shall be mandatorily submitted by the manufacturer of Packaged Drinking Water and Mineral Water while applying for renewal of license.


Q123. Is it required to submit Annual return[and penalty due to delay in submission, if any]while applying of renewal of license?


Ans: FBOs are required to pay the penalty levied due to delay in submission of Annual Returns [subject to maximum penalty levied shall not exceed 5 times of the annual license fee] before applying for the renewal of their licenses.This has come into the effect from FY 2021-22 onwards. Q124. Can I submit Annual return via offline or online mode?


Ans: FBOs are required to submit Annual Return via online mode only wef FY 2020-21 through Food Safety Compliance System (FoSCoS –https://foscos.fssai.gov.in ) and no offline submissionof Annual return (physically orthrough the mail) shall be accepted by the authorities.Please refer FSSAI Order vide number 15(31)2020/FoSCoS/RCD/FSSAIdated 18thDecember 2020.


Q125. I am a manufacturer of Milk and Milk Products. Do I need to submit Half Yearly Return?


Ans: FSSAI has discontinued the submission of Half yearly return (Form D2) by food businesses involved in manufacturing Milk and Milk Products wef. FY 2020-21. However, such food businesses are required to submit Annual Return (Form D1) through FoSCoS only. Please refer FSSAI Order vide number 15(31)2020/FoSCoS/RCD/FSSAI dated 18thDecember 2020.


Q126. How to make a request for reactivation of an auto-rejected application?


Ans:

A provision has been created in FoSCoS for the food businesses to self-activate the auto-rejected applications rejected due to non-response within 30 days to the queries of license/registration authority. Kindly refer to FSSAI order No. 15(31)2020/FoSCOS/RCD/FSSAIpt1 dated 04th December, 2023 issued in this regard, for more details. 


Q127. Do the Food category "13" (Foodstuffs intended for particular nutritional uses) fall under the scope of proprietary Foods while applying for license?


Ans: No, Proprietary food does not include foods for special dietary uses, foods for special medical purposes, functional foods, nutraceuticals, health supplements, and other food articles that the central government may notify on this behalf. Hence, no license under proprietary food can be applied for Food Product Category-13.


Q128. Is it necessary to self-attest all the documents prior to applying for license/registration?


Ans: Yes, all applicants are required toupload all self-attested documents by the authorised signatory/proprietor while applying for the license/registration.


Q129. How can I get my refund of erroneous/inadvertent payments in respect of license/registration fee?


Ans: FBO can get refund of erroneous/inadvertent payments credited into FSSAI Account in respect of license/registration fee and SOP for applying and processing of such refund is available on the homepage of FoSCoS portal. FBO shall raise the request for refunding of inadvertent/erroneous or duplicate payment only after 15 days from the date of such transaction.FBO may also lodge tickets through FBO help under FoSCoS login in the "payment related issue" category with necessary supporting documents.


Q130. I amapplying for FSSAI License under E-Commerce kind of business for the "Beverages" category (Food Product Category-14). Am I also eligible for sale of liquor after obtaining this license?


Ans: FBO needs to submit a self-declaration for not selling liquoronline if applied for Food Product Category-14 (Beverages) under E-Commerce Kind of Businesses.However, if FBO wants to sell liquor through e-Commerce, he has to submit NOC from the concerned State Excise department while applying for the license.


Q131. Do I require FSSAI registration if I am a last mile delivery person or Direct Selling Agent or Food Vending Machines, water vending machines, Food ATMs, or Branded Food Cart owned as a single/Main entity?


Ans: Last mile delivery person or Direct Selling Agent or Food Vending Machines, water vending machines, Food ATMs, or Food Cart owners have been exempted byFSSAI from obtaining registrations subjected to conditions mentioned in FSSAI letter vide no 15(6)2018/FLRS/RCD/FSSAI dated 8thJuly 2019 and 19thSep 2019.


Q132. Is it required to take FSSAI License at State/City-wise sub-offices of E-commerce FBOs?


Ans: No, FSSAI License is not required for E-commerce Food Businesses in all States, if no food businesses activities are being carried out as defined under clause 3(n)of FSS Act, 2006. However, E-Commerce FBOs (operating from two or more States) shall have one Head Office License and should maintain the record of their State/City-wise sub-offices.A copy of FSSAI license was issued to E-commerce FBO (at Head Office) shall also be displayed at a prominent place on the premises of sub-offices.

Q133. Is it mandatory for Manufacturers (including Repackers and Relabellers) to upload the Six monthly Lab Testing reports on FoSCoS?


Ans: Yes. As per FSSAI order number 15(31)2020/FoSCoS/RCD/FSSAIpt1-Part(1) dated 13.01.2023, all Manufacturers (including Repacker and Relabellers) shall upload six monthly lab testing reports in FoSCoS. The manufacturer may also link such lab reports from the InFoLNet wherever the samples are analysed by FSSAI-notified labs.


Q134. What is the last date for uploading six monthly lab test reports on FoSCoS?


Ans:

As per FSSAI order number 15(31)2020/FoSCoS/RCD/FSSAIpt1-Part(1) dated 13.01.2023, the last date for uploading/linking of the six-monthly lab test reports for the period April 2022 to September is 31st October and for the period of October to March is 30th April.

Further, for the FY 2022-23, FBOs are given time up to 31st March, 2023 for uploading/linking of the six-monthly lab test reports for the period April 2022 to September 2022.


Q135. I am a manufacturer with an active license. However, I have not produced any food products during the period of half year. What do I have to upload on the FoSCoS for this time period?


Ans: The manufacturer (including Repacker and Relabellers) with an active license who has not produced any food product during the half year period, shall have to upload a self-declaration on the firm's letterhead that firm has not produced any food product in place of lab testing report for that period. The self-declaration should be duly signed by the authorized signatory.


Q136. I am a manufacturer who produces different variants of the same product. Do I have to get all the variants of the same product tested as per FSSR?


Ans:

Case 1: No - in case, a manufacturer packaging the same product in different sizes (For ex. Same Fruit Juice with 1 ltr and 500 ml capacity), only one test report for the product is required to be uploaded or linked on FoSCoS.

Case 2: Yes - in case, a manufacturer produces different variants of the product with slight change/variation in ingredient or flavour or change in proportion of ingredients. Lab Test report for each variant of such product is required to be uploaded/linked on FoSCoS. For example: Separate Lab Test Report is required to be uploaded/linked for Juice with different flavours or different variants of pulses, spices or grains or sweets or namkeens [savouries] etc.


Q137. I am a manufacturer who produces different products using the same ingredient like dahi or paneer from milk which already has a test report. In such cases, milk product such as dahi or paneer need to be tested again as test report for milk is already available?


Ans: Yes.


Q138. As per condition of license, what parameters need to be tested under ‘relevant chemical and microbiological contaminants’ ?


Ans: Though it is recommended to test all the parameters as per FSSR, FBO shall at least test safety parameters specified under chemical (metal contaminants, crop contaminants and naturally occurring toxic substances, Polychlorinated biphenyls (PCBs) and Polycyclic Aromatic Hydrocarbon (PAH) compounds, residues, antibiotic and other pharma-cologically active substances, biotoxin, melamine, and histamine) and microbiological, as per applicability, to ensure production and delivery of safe food.


Q139. I am a manufacturer of ingredients/intermediate products (Business to Business purpose) which will then be used by the final formulators. As these products are not meant directly for human consumption, do I also need to test and upload such results on the FoSCoS ?


Ans: Yes. FBO shall ensure the compliance through testing wherever standards for such ingredients/intermediate products are available under FSSR. In absence of standards, at least safety parameters to be complied through testing.


Q140. In order to comply with conditions of license, is it mandatory to test food products in NABL lab only?


Ans: At present, as per the provision, FBO has the option to test it in its own or any NABL accredited lab or FSSAI notified labs.


Q141. I am an FBO falling under KoBs other than manufacturer i.e trade/retailer, transporter, importer etc. Do I also have to test the product as per FSSR ?


Ans: No. FSSAI order number 15(31)2020/FoSCoS/RCD/FSSAIpt1-Part(1) dated 13.01.2023, mandates only Manufacturers (including Repackers and Relabellers) to upload the Six monthly Lab Testing reports on FoSCoS.


Q142. I am a Repacker/Relabeller with an active license. I procure products from the licensed manufacturer who has already got tested the products endorsed in my license as per FSS Regulations. Do I need to get the products tested again?


Ans:

The Repacker/Relabeller shall ensure lab testing of all the products endorsed in their license either by Third Party Manufacturer [TPM] or themselves as per FSS Regulations (FSSR). In cases where the lab test reports for the product available from the TPM, Repacker/Relabeller need not to test these products again during the same period. In this case, they shall upload a self-declaration on the letterhead of their firm in the form of a table as specified below. The self-declaration should be duly signed by the authorized signatory.

Q143. Is it mandatory to have own laboratory facility by Relabellers having food products under fats and oil category ?  


Ans: Considering the extent of processing allowed, it is not mandatory to have in-house lab for Relabellers in case of fats and oil category. However, the requirement of lab is mandatory to manufacturers including Repackers as per clause 4 of Other Conditions of License under FSS (Licensing and Registration of Food Businesses) Regulations, 2011. Please also refer definition/scope of Repacker and Relabeller. 



Q144. Do online e-Commerce platforms require to undergo third-party audits for FSSAI compliance?



Ans: Online e-Commerce platforms are not required to undergo third-party food safety audits.


Q145. If an e-Commerce/Retail/Wholesale FBO is also involved in operation of warehouse/storage/wholesale store/retail store activities, then who shall obtain FSSAI License / Registration for the warehouse / storage/ wholesale store/retail store premises?



Ans: E-commerce/Retail/Wholesale FBOs who are involved in the operations of warehouse/storage/wholesale store/retail store activities are required to obtain an FSSAI license/registration. It may also be noted that individual sellers are not required to obtain a separate FSSAI license/registration for the same warehouse/storage/wholesale store/retail store facility which is already licensed / registered and provided by a partner Wholesale /Retail /e-commerce FBO platform.



Q146. Whose FSSAI license number needs to be printed on the purchase invoices/bills in case of purchase is made from an e-commerce platform?


Ans: The FSSAI license /registration number of the seller as well as the e-commerce FBO from whose platform the sale has been made shall be printed on the purchase invoices/bills etc to ascertain the traceability of the product.

Q147.

My application for modification of license/Registration is in process, Can I file a new application for modification to amend/add further information?


Ans:

Filing a new application for modification to add/amend further information, the FBO has to cancel the existing (in-process) application for modification from the provision available under the ‘Submitted Applications' bin on FBO's FoSCoS dashboard. If the application is cancelled, the modification application fee (Rs. 1000/- plus GST and any differential fee (if any) for License and Rs. 100/- for Registration) will be forfeited.

Additionally, it is also informed that FSSAI, vide order number RCD-01003/2/2022 Regulatory-FSSAI dated 29-12-2022 has implemented the instant Modification of license in the Kind of Businesses such as Vegetable Oil processing units and General Manufacturing except for the food categories 01, 08, 09, 13 and 99.



Q148. Is it mandatory to obtain separate non-specified food/food ingredient approval by the manufacturer, if the manufacturer is the contract manufacturer for the Re-labeller [brand owner] who has already obtained the product approval for the same product? 


Ans:

No, it is not mandatory for third party [contract] manufacturer to obtain separate product approval for the same non-specified food product for which Relabeller [brand owner] has already obtained the product approval, provided there is an agreement between the third party [contract] manufacturer and the Relabeller [brand owner] for manufacturing of this particular non-specified food product for which product approval has been obtained by Relabeller [brand owner]. Third party manufacturer while applying new license or modification of license shall endorse such product by providing the copy of such agreement along with the approval letter by the Relabeller [brand owner]. 


Further, the third party [contract] manufacturer shall be requiring the product approval, in case he/she is manufacturing the same product for his/her own brand name.

Q149.  I want to export both food and non-food items. Is it allowed to take FSSAI exporter - manufacturer and/or merchant-exporter license for both food and non- food items? 


Ans: No. It is not allowed to apply for FSSAI exporter license (manufacturer and/or merchant) for non-food items as the same does not fall under the purview of FSSAI. In such cases, license may be obtained from concerned authorities of India. 


Q150. I want to manufacture and export products to different countries. The product meant for export falls under the scope of food (i.e supplements) in importing country while in India the same product falls under drug/pharmaceutical / Ayush Medicine category. In such case, am I allowed to take FSSAI exporter license? 


Ans: No. It is not allowed to apply for FSSAI exporter licensefor drugs including Ayurvedic Proprietary Medicine as the same does not fall under the purview of FSSAI. In such cases, license may be obtained from concerned authorities of India. 


Q151. I am manufacturing food products in India and want to export the same to another country. In such case, is it mandatory to have FSSAI logo and license number on the label of the exported products? 


Ans: Exporters who have obtained FSSAI license as per order No. 1-351/FSSAI/Imports/2013 dated 21st January, 2015 shall mention FSSAIlogo and license number (either in printed or Barcode/QR format) on the food product label to ensure traceability. Further, other requirements as per FSS (Labelling and Display) Regulations, 2020 may not be applicable for the exported products. 


Q152. Whether NOC from FSSAI is required for export? 


Ans: No, NOC is not required by the Food Safety and Standards Authority of India for exporting food products from India. However, exporter may obtain FSSAI license as per Order No. 1-351/FSSAI/Imports/2013 dated 21st January, 2015.



Q153. I am a manufacturer and want to obtain a license/registration under FoSCoS for ingredients such as sesame seed, sunflower seed or flax seed, but I am unable to find the relevant category. What category should I choose?


Ans:

FBOs may obtain a license/registration, as applicable, for sesame seeds, sunflower seeds, or flax seeds under Food Category ‘99.7 - Ingredients listed under the Food Safety and Standards Regulations, excluding nutraceutical regulations’.


Q154. I am a manufacturer and want to obtain a license/registration under FoSCoS for ingredients such as watermelon seed or pumpkin seed. What category should I choose?


Ans: Please refer FSSAI Order No. RCD-12005/1/2021-Regulatory-FSSAI-Part 2 dated 15.03.2024 for details on the food category for licensing/registration of edible dried fruit seeds and edible dried vegetable seeds.

Q155. How should freshly prepared meals served to passengers on trains, airlines, or ships be labeled?


Ans:

Labelling of freshly prepared food such as dal, cooked rice, dessert, sandwich, fresh cut salad/fruits etc. served to passengers on trains, airlines or ships shall be as per FSS (Labelling and Display) Regulations, 2020 and FSSAI’s Advisory vide number RCD-15001/11/2023-Regulatory-FSSAI dated 07th March 2024. The information can be provided on the packaging/wrapping material in which food is packed.

If it is difficult to provide information on packaging/wrapping material, then it may alternatively be provided in a separate brochure/flyer/leaflet, which should be handed over to consumers at the time of serving of food.

Q156.

My FSSAI license does not have the signature of the issuing authority. Is it authentic?


Ans:

FSSAI Licenses and Registrations are system-generated documents issued through the Food Safety Compliance System (FoSCoS). In the case of auto-generated and instant-generated licenses and registrations, a digital signature may not be present on the issued license/registration copy. The Authenticity of FSSAI License/Registration can be verified through QR code printed on the

License/Registration copy.

How can I search the details of Licensed/Registered Food Business Operators (FBOs)?


Ans:

The details of Licensed/Registered Food Business Operators (FBOs) can be obtained from the FoSCoS website. Users can search for FBOs based on:

  • Kind of Business

  • Food Product Category

  • Sub-category and Product Name

  • State-wise & District-wise details

This information is available under the ‘FBO Search’ tab on the Homepage of FoSCoS. The search tool can be access at https://foscos.fssai.gov.in/advance-fbo-search. Additionally, the State-wise count of active and issued licenses/registrations can also be obtained from the ‘Data Statistics’ tab available under the ‘FBO Search’ section. Q158. When do I pay the remaining fee for my FSSAI license after the initial application fee?


Ans:

An initial application fee of Rs. 1000 + GST (as applicable) is payable at the time of submission. Once the Licensing Authority has reviewed the application and found it to be complete in all respects, the remaining differential amount i.e., total applicable license fee minus Rs. 1000 [already paid as initial application fee] along with the GST [as applicable] on the differential amount must be paid by the Food Business Operator (FBO) on FoSCoS within 30 days.

Failure to pay the remaining fee within the stipulated time will result in the auto-rejection of the application.

Q159. What address should transporters and caterers provide while applying for an FSSAI License or Registration?


Ans: Transporters and caterers shall apply FSSAI License / Registration at their Registered Office address. Similarly, in case of food businesses operating through mobile units, such as moving vehicles or carts, the FSSAI License/Registration must be obtained for the base kitchen where food is prepared and stored before being loaded onto the mobile unit.


Q160. Is there any fee waiver for FSSAI Registration?


Ans:

FSSAI has waived off the registration fee for both hawkers and Anganwadi (ICDS) Centres. The details are as below:

  1. HawkersEffective from 28th September 2024

    • New registrations will be granted a registration certificate valid for five years (without an option for selection of validity from one to five years).

    • The fee waiver also applies to renewal of registration certificates.

  2. Anganwadi (ICDS) CentresEffective from 12th March 2025

    • Registration certificates for Anganwadi Centres will also be issued for five years, and the fee waiver applies to both new registrations and renewals.

    • Additionally, a new Kind of Business (KoB) for 'Anganwadi (ICDS) Centres' has been introduced under the Food Safety Compliance System (FoSCoS).

Q161.

Which packaging material requires the certificate of conformity issued by NABL accredited laboratory ?


Ans: As per provision 3(14) of FSS (Packaging) Regulations, 2018, certificate of conformity issued by NABL accredited laboratory is mandatory for the packaging material which comes in direct contact with food or layers likely to come in contact with food. The Certificate of conformity of packaging material shall be verified at the time of inspection of manufacturing and catering establishments as per FSSAI order No. 15(31)2020/FOSCOS/RCD/FSSAIPt.17 dated 03rd April, 2025
